Postlybee is a hosted software-as-a-service product operated by BIGWHALE LTD. These Terms of Service form a legally binding agreement between you and BIGWHALE LTD.

By accessing or using Postlybee, you agree to be bound by these Terms of Service and any policies or guidelines referenced in them. If you use Postlybee on behalf of a company, agency, or other legal entity, you represent that you have authority to bind that entity to these terms.

If you do not agree to these terms, you must not access or use Postlybee.

These terms apply to your use of https://postlybee.com, your Postlybee account, our hosted software platform, APIs, related websites, customer support, and any features made available by BIGWHALE LTD.

Postlybee is a hosted SaaS platform that helps users plan, create, schedule, publish, manage, and analyze social media content, team workflows, media assets, and related marketing operations.

Features may include social account connections, workspace collaboration, content scheduling, approvals, media uploads, AI-assisted tooling, analytics, automations, and other publishing or marketing capabilities made available from time to time as part of our hosted commercial offering.

Some features depend on third-party infrastructure, payment providers, AI providers, or social platforms. Availability may vary based on your subscription plan, feature rollout status, account standing, and the availability of those external services.

You must provide accurate, complete, and current registration information and keep it updated. You are responsible for safeguarding your login credentials and for all activities that occur under your account.

You may use the service only if you are legally able to enter into a binding agreement and only in compliance with applicable laws, regulations, and third-party platform rules.

If you create or administer accounts for teammates, clients, contractors, or other users, you are responsible for assigning permissions appropriately and ensuring those users comply with these terms.

Subject to these terms and any applicable subscription or payment obligations, BIGWHALE LTD grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use Postlybee as a hosted service for your internal business or personal use.

You may not resell, lease, sublicense, mirror, scrape, reverse engineer, or use Postlybee to build a competing service except to the extent such restrictions are prohibited by applicable law.

Any rights not expressly granted to you are reserved by the applicable rights holder.

We may offer free trials, promotional access, pilot programs, or beta features at our discretion. These offerings may be limited in duration, functionality, storage, support, or availability.

Beta, preview, early-access, or experimental features may be changed, suspended, or removed at any time without notice and may be provided with reduced reliability or support.

Unless we explicitly say otherwise, free trials and beta features are provided without any service commitment, warranty, uptime obligation, or guaranteed retention of data or settings.

You may not use Postlybee to violate any law, infringe the rights of others, distribute malware, gain unauthorized access, interfere with the platform, or publish unlawful, deceptive, abusive, infringing, defamatory, or fraudulent content.

You may not use the service to send spam, impersonate others, evade platform enforcement, harvest credentials, overload infrastructure, bypass security or billing controls, or misuse APIs, automations, browser extensions, or integrations.

You remain solely responsible for your content, publishing decisions, connected accounts, and compliance with the rules, terms, and policies of every third-party platform you use with the service.

If BIGWHALE LTD reasonably believes your use creates operational, security, legal, reputational, or payment risk, we may limit, suspend, investigate, or terminate the affected activity or account.

You retain ownership of the content, media, text, prompts, brand assets, and other materials you submit to the service. You grant BIGWHALE LTD a limited, worldwide license to host, store, process, transmit, reproduce, and display that content solely as necessary to operate, secure, maintain, and improve the service.

When you connect third-party accounts or services, you authorize Postlybee to access and act on those services according to the permissions you grant. Your use of those third-party platforms remains subject to their own terms, policies, and technical limitations.

You represent and warrant that you have all rights, permissions, and consents necessary to upload, schedule, publish, process, and distribute your content through the service and any connected third-party platform.

BIGWHALE LTD is not responsible for third-party platform removals, moderation actions, suspensions, API changes, outages, or policy enforcement decisions that affect your use of the service.

Postlybee, including its software, platform design, branding, layout, documentation, APIs, and underlying technology, is protected by intellectual property laws and remains the property of BIGWHALE LTD and its licensors.

Except for your own content and any open-source components governed by separate licenses, you may not copy, modify, distribute, publicly display, create derivative works from, or exploit any part of the service except as expressly allowed by these terms.

If you submit feedback, ideas, or suggestions about Postlybee, BIGWHALE LTD may use them without restriction or compensation to you unless otherwise agreed in writing.

Certain features of the service require a paid subscription or other fees. Pricing, plan limits, included features, usage caps, and billing intervals are described on the applicable pricing or checkout pages.

Unless otherwise stated, subscriptions renew automatically for the same subscription term until canceled. You authorize us and our payment processors to charge your selected payment method for recurring fees, taxes, and any applicable usage-based charges.

You are responsible for all applicable taxes, duties, and similar governmental assessments except taxes based on our net income.

If payment fails or your account becomes delinquent, we may retry billing, suspend access to paid features, downgrade your plan, or terminate the account until outstanding amounts are paid.

BIGWHALE LTD may modify pricing, packaging, plan features, or service functionality from time to time. Material changes will take effect prospectively unless immediate changes are required for security, legal, or operational reasons.

You may cancel a paid subscription so that it does not renew for a future billing period. Except where required by law or expressly stated in writing, fees already paid are non-refundable and non-creditable.

We aim to operate a reliable SaaS service, but we do not guarantee uninterrupted uptime, continuous availability, or error-free operation.

Maintenance, security work, feature updates, third-party outages, internet disruptions, infrastructure incidents, and social-platform changes may temporarily affect availability or functionality.

Unless we expressly agree otherwise in writing, support is provided on a commercially reasonable basis and does not include guaranteed response or resolution times.

You may stop using the service at any time and may cancel your subscription according to the billing settings available in your account, if applicable.

BIGWHALE LTD may suspend, restrict, or terminate your access immediately if you breach these terms, misuse the service, fail to pay applicable fees, create risk or liability, or if we are required to do so by law or by a third-party platform or provider.

We may also remove or disable access to specific content, integrations, workspaces, or features where necessary to protect the service, comply with law, or prevent abuse.

Upon termination, your right to use the service ends immediately. We may delete or disable account access and stored content according to our retention practices, and provisions that by their nature should survive termination will remain in effect.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BIGWHALE LTD, its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your content, your connected accounts, your use of the service, or your violation of these terms, applicable law, or third-party rights.

This includes reasonable legal fees and costs arising from disputes with customers, clients, collaborators, regulators, social platforms, or rights holders caused by your acts or omissions.

Postlybee is provided on an "as is" and "as available" basis to the maximum extent permitted by law. To the fullest extent allowed by law, BIGWHALE LTD disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, BIGWHALE LTD will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunities, or anticipated savings arising from or related to your use of Postlybee.

Where liability cannot be excluded, BIGWHALE LTD's total liability for any claim arising out of or related to the service will be limited to the amount you paid to BIGWHALE LTD for the service during the twelve months preceding the event giving rise to the claim, or the minimum amount required by applicable law if greater.

Some jurisdictions do not allow certain disclaimers or liability limitations, so portions of this section may not apply to you.

Unless a separate written agreement states otherwise, these terms are governed by the laws applicable to BIGWHALE LTD, without regard to conflict-of-law rules.

You and BIGWHALE LTD agree to attempt to resolve disputes informally before filing a formal legal claim. If a dispute cannot be resolved informally, it will be brought before the courts or tribunals with proper jurisdiction over BIGWHALE LTD or as otherwise required by applicable law.

Nothing in this section prevents either party from seeking injunctive or equitable relief where necessary to protect rights, data, confidential information, or platform security.
